These Terms of Service ("Terms") govern your use of the services provided by Noble Property Inspections ("Company," "we," "our," or "us"). By scheduling an inspection or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Services
Noble Property Inspections provides professional property inspection services, including but not limited to residential home inspections, commercial inspections, 11-month warranty inspections, mold inspections, and related ancillary services. All inspections are performed by trained and certified inspectors in accordance with applicable industry standards and state licensing requirements. The scope of each inspection is defined by the service type selected at the time of booking and will be outlined in the inspection agreement provided prior to or at the time of service.
Scheduling & Cancellation
Inspections may be scheduled through our website, by phone, or by email. Appointment availability is subject to inspector schedules and geographic coverage.
- You agree to provide accurate and complete property information at the time of scheduling.
- Cancellations made at least 24 hours before the scheduled inspection will receive a full refund.
- Cancellations made less than 24 hours before the appointment may be subject to a cancellation fee. See our Cancellation Policy for full details.
- We reserve the right to reschedule or cancel an inspection due to weather, safety concerns, or circumstances beyond our control. In such cases, we will work with you to reschedule at no additional cost.
Payment
Payment is due at the time of booking unless otherwise agreed upon in writing. We accept major credit cards and other payment methods as indicated during the booking process.
- All prices are quoted in US dollars and are subject to change. The price confirmed at the time of booking will be honored for that appointment.
- Additional fees may apply for add-on services, reinspections, or properties that differ from the information provided at booking (e.g., larger square footage).
- Refunds for cancellations are processed in accordance with our Cancellation Policy.
Inspection Scope & Limitations
Our inspections are visual, non-invasive examinations of the accessible areas of a property at the time of inspection. Please be aware of the following limitations:
- Inspections do not include areas that are inaccessible, concealed, or obstructed (e.g., behind walls, under flooring, or in locked spaces).
- Inspections are not a guarantee of the condition of the property and do not constitute a warranty or insurance policy.
- Inspectors are not required to move furniture, personal belongings, equipment, or other items that may obstruct areas of the property.
- The inspection represents the condition of the property at the time of the inspection only. Conditions may change after the inspection date.
- Inspectors may recommend further evaluation by licensed specialists for issues that fall outside the scope of the inspection.
Reports
Inspection reports are delivered digitally, typically on the same day as the inspection. Reports include:
- A written summary of observations and findings with photographs.
- Identification of material defects and safety concerns observed during the inspection.
- Recommendations for further evaluation where applicable.
Reports are prepared for the exclusive use of the client who ordered the inspection. The report remains the intellectual property of Noble Property Inspections and may not be reproduced or distributed to third parties without our written consent, except as required by law or as necessary for the real estate transaction.
Liability
Our liability is limited as follows:
- In no event shall the total liability of Noble Property Inspections exceed the fee paid for the inspection service giving rise to the claim.
- We are not liable for any consequential, incidental, or indirect damages, including but not limited to loss of property value, repair costs exceeding the inspection fee, or lost profits.
- Any claim arising from the inspection must be reported to us in writing within a reasonable period of discovery, and in no event later than one (1) year from the date of the inspection.
- We are not responsible for conditions that were not reasonably observable during a visual inspection or that developed after the inspection date.
Dispute Resolution
In the event of a dispute arising from our services, both parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state of Texas. Each party shall bear their own costs and attorney's fees unless otherwise determined by the arbitrator. These Terms shall be governed by and construed in accordance with the laws of the State of Texas.
Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
